2. Who we are
Fairbrass Training is the seller of the courses and services offered through this website. You are contracting directly with Fairbrass Training when you purchase a course or use our services.
3. Authority to use the service
By using our website, you confirm that you are at least 18 years old and have the legal capacity to enter into these terms, or that you have authority to bind the organisation you represent. You are responsible for ensuring that anyone who uses your account is aware of and complies with these terms.
4. Our services
Fairbrass Training provides online awareness and foundation training courses, as well as face-to-face and classroom training where advertised. Online courses are accessed through your account after purchase. Course descriptions, durations, and pass requirements are set out on each course page.
We aim to provide uninterrupted access to purchased courses, but we do not guarantee that the website or any course will be available at all times, error-free, or free from interruption. Occasionally, we may need to suspend access for maintenance, updates, or reasons beyond our control.
5. Your account and credentials
You are responsible for keeping your account login details secure and for all activity that occurs under your account. You must provide accurate information when creating an account and keep it up to date. You must notify us promptly if you suspect any unauthorised use of your account.
6. Acceptable use
You must not use the website or our courses for any unlawful purpose or in any way that:
- violates any applicable law or regulation;
- infringes or misappropriates any intellectual property or other rights;
- involves fraud, spam, or deceptive practices;
- attempts to interfere with the security, availability, or performance of the website;
- uses automated tools, scraping, or probing to access or extract data;
- shares, resells, redistributes, or sublicenses course content or access;
- reverse engineers, decompiles, or circumvents any technical protections.
7. Intellectual property
All content on the website and within our courses, including text, images, videos, graphics, logos, and software, is owned by or licensed to Fairbrass Training and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the content for your own personal or internal training purposes. You may not copy, modify, distribute, or create derivative works from our content without our written permission.
8. Payments and billing
Fairbrass Training is the seller of record for all online course orders. Payments are processed securely by Stripe, our payment processor. All prices are shown and charged in pounds sterling (GBP) and are inclusive of any applicable tax. By completing a purchase, you agree to Stripe's applicable buyer terms in addition to these terms.
Fairbrass Training is VAT registered. Where applicable, the price you pay includes VAT at the current UK standard rate of 20%. A VAT breakdown is shown on your checkout receipt and in the payment confirmation email.
For face-to-face courses, payment terms and invoicing are agreed directly with Fairbrass Training unless otherwise stated.
9. Refunds
Our refund policy is available at /refund-policy. Online course purchases are eligible for a refund within the period set out in that policy, provided the course has not been completed and no certificate has been issued. Refund requests are handled by Fairbrass Training and processed back to your original payment method through Stripe.
10. Suspension and termination
We may suspend or terminate your access to the website or any course if you breach these terms, fail to pay amounts due, engage in fraudulent or unlawful activity, or create a security risk. We may also terminate accounts that are inactive for an extended period. Upon termination, your right to access the affected course or service ends immediately.
11. Warranties and liability
Our online courses are provided for awareness and foundation training purposes. They do not replace site-specific training, formal vocational qualifications, or employer-led health and safety instruction. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Our aggregate liability to you for any claim arising out of or relating to these terms or our services will be limited to the amount you paid for the relevant course in the 12 months preceding the event giving rise to the claim. We will not be liable for any indirect, consequential, special, or punitive damages, including loss of profits, revenue, data, or goodwill, except where liability cannot be excluded by law (such as for fraud, death, or personal injury).
12. Indemnity
You agree to indemnify and hold Fairbrass Training harmless from any claims, losses, or liabilities arising from your use of the website, your content, your breach of these terms, or your violation of any law or third-party rights.
13. Changes to these terms
We may update these terms from time to time. The current version will always be posted on this page with the "Last updated" date. Continued use of the website after any changes means you accept the updated terms.
14. Governing law and disputes
These terms are governed by the laws of England and Wales. Any dispute arising from these terms or your use of the website will be subject to the exclusive jurisdiction of the courts of England and Wales.
